accurART Fine Art Insurance Broker (hereinafter referred to as “accurART Switzerland”) is an independent and unaffiliated insurance broker subject to supervision by the Swiss Financial Services Authority (“FINMA”) within the context of brokerage supervision.

 

accurART Switzerland cooperates with various companies working in the domain of insurance as well as with companies affiliated with them (hereinafter: “insurance companies”). Depending on the Client’s insurance needs, accurART Switzerland works with the insurance companies in the area of art insurance, in general policies in that area and partially also in other insurance lines of business. accurART Switzerland works on behalf of its client based on the terms & conditions of contract agreed in the broker letter of records and the General Terms & Conditions of Business of accurART Switzerland.

 

For errors, negligence, or incorrect information by advisors in connection with its brokerage activity, accurART Switzerland shall be liable as provided for and pursuant to the liability provisions in the broker letter of records and the General Terms & Conditions of Business of accurART Switzerland as amended. Our advisors entrusted with the conclusion of insurance contracts are registered with FINMA in accordance with the statutory provisions. The registration can be viewed via the FINMA intermediary portal. This registration and its requirements ensure that the advisors have the specialist knowledge (Education and further training) required by law within the meaning of Art. 43 ISA in conjunction with Art. 43 VAG. Art. 190f. AVO and that you can obtain information about this.

 

Personal data will be recorded by the advisors only to the extent required within the context of the service agreed in the Brokerage Contract. accurART Switzerland undertakes to take all precautions necessary to comply with the applicable provisions of law on data protection. The data will be treated as strictly confidential. As a rule, personal data will be achieved in electronic and/or in paper form. With its signature, the Client hereby authorises accurART Switzerland explicitly to forward information expressed on to third parties, as long as and to the extent that this is necessary for provision of the services agreed under the Brokerage Contact. Otherwise, the forwarding of such information requires the explicit consent of the Client.

Prior to award of contract the foregoing information shall be provided as part of the duty to provide information under Article 45 of the VAG Act, including a list of the Insurance Companies with whom accurART Switzerland cooperates.

accurART Europe and the employees assisting in insurance brokerage hold an official permit of the Financial Markets Regulatory Authority in Liechtenstein to perform the activity as an insurance broker and are entered in the Insurance Brokers Register of the FMA - Financial Market Authority in Liechtenstein.

Financial ties with insurance companies

accurART Europe holds no direct or indirect interests whatsoever in the voting rights or the capital of any particular insurance company, nor does any particular insurance company or its parent company hold any direct or indirect interest whatsoever.
 

Options to complain with regard to the insurance brokerage

Complaints in connection with the insurance brokerage pursuant to Article 74 VersVertG may be addressed to the Financial Markets Regulatory Authority at the following address: FMA Finanzmarktaufsicht Liechtenstein, Landstrasse 109, PO Box 279, LI-94901 Vaduz.
 

Conciliation board

Pursuant to Art. 75 VersVertG in conjunction with the Financial Services Conciliation Board Ordinance (FSV), the out-of-court consiliation board is responsible for settling disputes between clients and insurance brokers regarding the services provided.
